WHO IS A COMMISSIONER OF OATHS?


In 2018, many UK laws applied to the verification of documents and identity. Oath Commissioner in English Law plays an integral role in various affidavits and statutory declarations, appointed by the Lord Chancellor. You may need Commissioner of Oath services if you are; giving evidence in Ireland on affidavits for court proceedings or making an affirmation, declaration, acknowledgement, examination or attestation for court proceedings/purposes of registration of documents.

  • Affidavits: An affidavit is a written form of evidence used in court proceedings. A Commissioner for Oaths who is a Solicitor and Non-solicitor hold separate powers.

Solicitors: Cannot use their powers in proceedings where they are acting for parties involved or where they have a conflicting interest.

Non-solicitor: Must NOT practice outside their appointed field.

Peace Commissioner: A Commissioner for Oaths who is also an acting Peace Commissioner can NOT charge fees for administering oaths, taking declarations or affirmation that they cannot charge for as a Peace Commissioner. 


WHAT ARE THE FUNCTIONS OF A COMMISSIONER FOR OATHS?


Essential functions of an oath commissioner include:

  • Ensuring the evidence in question is in written form (draft affidavit)
  • Establishing that previous persons have read the draft affidavit and fully recognise its contents
  • Raising the appropriate Testament and repeating the words of the oath from the person to swear the affidavit is trust
  • Verify the testimony correctly sworn by completing a "jurat" on the affidavit
