Appeal Eligibility

When your application for a UK visa or immigration status is rejected by the UK Home Office or Government, you retain the right to appeal the decision and seek a reversal.

You may be eligible to appeal to the First-tier Tribunal (Immigration and Asylum Chamber) if the Home Office has taken any of the following actions:

  • Declined your protection claim (commonly known as an ‘asylum claim’ or ‘humanitarian protection’).
  • Refused to consider your human rights claim.
  • Made a decision under the European Economic Area (EEA) Regulations, such as deportation, refusal of residence documents, revocation of protection status, or withdrawal of British citizenship.
  • You may also be entitled to appeal to the First-tier Tribunal (Immigration and Asylum Chamber) if the Home Office made a decision before 6 April 2015.

The tribunal operates independently, and a judge will carefully consider both sides of the argument before reaching a decision.

How Long Does a Visa Appeal Take?
