That’s why we’re committed to assisting you every step of the way, whether you are an executor responsible for administering the estate or a beneficiary awaiting your inheritance.

Understanding Probate Administration

Probate administration is the legal process that encompasses the management and distribution of a deceased person’s estate.

Our team at Tann Law is well-versed in the intricacies of this process, and we’re here to help you navigate it with confidence.

Here’s a breakdown of what probate administration entails:

Executor Identification: If the deceased left a valid will, it typically designates an executor. This individual is tasked with overseeing the probate process, ensuring the deceased’s wishes are honoured, and managing the estate’s affairs.

Death Registration: The initial step in probate involves formally registering the death. Simultaneously, funeral arrangements are made, with expenses potentially covered from the estate’s funds, to be reimbursed later.

Estate Valuation: It’s essential to identify and value all assets and liabilities of the deceased. This includes assessing the value of properties, bank accounts, investments, and any outstanding debts or bills.

Inheritance Tax: Depending on the estate’s total value, inheritance tax may apply. Executors are responsible for calculating and paying this tax, leveraging any applicable allowances or exemptions.

Grant of Probate: To gain legal authority to administer the estate, the executor (or next of kin in the absence of a will) must apply for a Grant of Probate. Without a will, this is known as applying for Letters of Administration.

Asset Collection: Once the Grant of Probate is secured, the executor can start collecting assets, settling debts, and addressing any legal challenges or disputes that may arise.

Estate Accounts and Distribution: After all assets are gathered, and debts are resolved, the final step is to distribute the estate’s assets to beneficiaries in accordance with the will’s terms. Estate accounts are prepared for transparency and accountability.

Applying for Probate with Tann Law

When it comes to applying for probate, Tann Law offers comprehensive support throughout the process:

Estate Assessment: We help you assess the estate’s size and complexity, determining the appropriate application forms and procedures. This may involve obtaining a copy of the original will, identifying significant assets, and estimating their values.

Application Completion: Our team assists in completing the probate application form, tailored to the estate’s value. In England and Wales, we use the ‘IHT 205’ form for estates valued below the inheritance tax threshold and the ‘IHT 400’ form for larger estates.

Executor’s Oath: We guide you through the executor’s oath, ensuring that all details provided in the application are accurate. This can be done at the Probate Registry or with the support of our experienced lawyers.

Foreign Assets and Properties: If the deceased had assets or properties abroad, we work with you to navigate any foreign legal processes, ensuring compliance with relevant laws.
