Appeal Eligibility
When your application for a UK visa or immigration status is rejected by the UK Home Office or Government, you retain the right to appeal the decision and seek a reversal.
You may be eligible to appeal to the First-tier Tribunal (Immigration and Asylum Chamber) if the Home Office has taken any of the following actions:
- Declined your protection claim (commonly known as an ‘asylum claim’ or ‘humanitarian protection’). Learn more on GOV.UK
- Refused to consider your human rights claim.
- Made a decision under the European Economic Area (EEA) Regulations, such as deportation, refusal of residence documents, revocation of protection status, or withdrawal of British citizenship. More details on EEA regulations are available, here.
You may also be entitled to appeal to the First-tier Tribunal (Immigration and Asylum Chamber) if the Home Office made a decision before 6 April 2015.
The tribunal operates independently, and a judge will carefully consider both sides of the argument before reaching a decision.
How Long Does a Visa Appeal Take?
